Semi-Truck Driver Attempting To Avoid Vehicle Dies After Slamming Into Bridge Embankment

A truck driver was fatally injured after slamming into an embankment on Interstate 55.

According to Illinois State Police, a witness to the crash said that a Nissan Maxima on the left shoulder pulled onto the highway, in the path of the truck. The semi-truck driver swerved but could not avoid hitting the Nissan, sending it off the left side of the road and into a median cable barrier. The truck veered off the right and slammed into a bridge embankment. The driver of the Nissan suffered serious injuries; the truck driver was pronounced dead at the scene. The crash is under investigation.

Death of a family member, especially a bread winner, caused by the fault of another person can have devastating legal and financial consequences for the unfortunate victim’s family. Wrongful death lawsuits or claims are generally filed by surviving family members or beneficiaries of the deceased victim. The family can collect monetary damages to cover the loss of earnings that the victim would have made in his lifetime, death associated expenses (funerals, medical bills), pain and suffering, and loss of companionship.

While the at-fault driver may find in difficult to avoid liability, the possibility still remains that the truck driver may have contributed to the crash, lessening the at-fault driver’s responsibility. For example, if the investigation determines that the trucker was speeding, he may be held partially liable. Insurance companies will fight to the end and attempt to deny, delay, and defend the claim. Even if it is determined that the Nissan driver was clearly at fault, the insurance company won’t automatically agree. It must be proven through a police report, witness testimony, and other evidence. This can delay a lawsuit for years.
